Isla Las Palmeras General Terms and Conditions as of September 1, 2024

Terminology

  • Guest: A person who has reserved and is staying at Isla Las Palmeras in Alora and is registered as such.
  • Lead Guest: The person who made the reservation at Isla Las Palmeras. The lead guest must be over 18 years old and is responsible for their companions, payment for the stay, and compliance with the terms and conditions.
  • Manager: The person managing the suite rental as the owner or on behalf of the owner.
  • Third Parties: Any other entities that are not a guest, manager, or owner.
  • Reservation: A confirmation of the reservation request by Isla Las Palmeras in Alora.
  • Cancellation: The act of revoking or dissolving a confirmed reservation within the applicable period or a no-show at the time of reservation.

1: General

1.1 Our company is described on the website www.islalaspalmeras.com. While this website has been created with the utmost care, there may be differences between the text and/or photos presented on the website and the actual situation in the suites at the time of the guest’s visit. Guests cannot derive any rights from such differences.

1.2 The minimum stay at Isla Las Palmeras is 3 nights.

1.3 Our suites are accessible 24 hours a day. The suites have their own lockable entrance.

1.4 Quiet hours are from 10:00 PM to 7:00 AM. We kindly ask you to limit noise during these times.

1.5 Smoking is not permitted in the rooms or in common areas or anywhere indoors. Smoking is allowed outside. Guests are provided with the necessary ashtrays and are kindly requested to ensure that ash and cigarettes are disposed of only in the ashtrays.

1.6 Pets are not allowed at Isla Las Palmeras, Alora.

1.7 Suite Pizarra accommodates up to 4 people. Suite Alora accommodates up to 2 adults and 1 child under 18 years (using a sofa bed).

1.8 Check-in is between 3:00 PM and 10:00 PM; check-out is by 11:00 AM. Late check-in and check-out may be possible by arrangement.

1.9 Guests can park their cars on our private parking lot. Parking is at the guest’s own risk.

1.10 Guests must have a fixed residence or place of stay, and a copy of ID will be requested at booking for proper registration.

1.11 Guests must follow the instructions of the owners.

1.12 Owners may deny or refuse access to Isla Las Palmeras, Alora immediately to guests who violate the general terms and conditions and/or house rules or exhibit inappropriate behavior, without further notice or reason, and without refunding accommodation and cleaning costs.

1.13 Guests of Isla Las Palmeras, Alora must adhere to the house rules provided online at the time of booking.

2: Rates

2.1 Rates include gas, water, electricity, internet, Wi-Fi, and heating. Rates include VAT and tourist tax.

2.2 Rates do not include cancellation and/or travel insurance or other costs. These must be arranged by the guests and are at their own expense.

2.3 Rates are always subject to change and are non-binding.

2.4 All information on the Isla Las Palmeras, Alora website (www.islalaspalmeras.com) is provided in good faith and is subject to interim adjustments. Isla Las Palmeras, Alora is not bound by obvious errors on its website.

2.5 For winter guests, we offer adjusted rates. If you have any questions, please feel free to send us an email or WhatsApp message or give us a call.

Reservation and Payment

3.1 The reservation is only confirmed upon receipt of confirmation from Isla Las Palmeras.

3.2 For reservations, 50% of the reservation amount must be paid within 8 days of booking to Isla Las Palmeras, Alora. A reservation confirmation will only be issued after receiving this deposit. The remaining amount for the stay, including cleaning costs, must be paid upon arrival. The deposit and/or total accommodation costs should be transferred to: Jan Cox IBAN: NL11 RABO 0123644011, with the full name and address of the booker. Credit cards are not accepted, and payment by PIN is not possible. If the check-in date is within 8 days of booking, the full amount must be paid at the time of booking.

Cancellation

4.1 You are responsible for cancellations due to emergencies or force majeure shortly before or during the stay. We advise taking out cancellation and/or travel insurance. See below for our cancellation terms. 4.2 Cancellations up to 60 days before arrival will incur 25% of the accommodation costs. Cancellations between 30 and 60 days before arrival will incur 50% of the accommodation costs. Cancellations between 14 and 30 days before arrival will incur 75% of the accommodation costs. Cancellations within 14 days of departure will incur the full accommodation costs.

Damage

5.1 The guest must behave appropriately and use Isla Las Palmeras, Alora in accordance with the reasonable use instructions given by Isla Las Palmeras, Alora or the owner/manager. Isla Las Palmeras is lovingly provided and maintained, and we wish to keep it in excellent condition for our guests.

5.2 The lead guest is legally responsible for any damage caused to Isla Las Palmeras, Alora or its contents by themselves or their companions.

5.3 Any damage (damage, loss, disappearance, and/or theft) must be reported immediately to the owner or manager by the guest. Repair or replacement costs must be reimbursed to the owner/manager promptly upon request.

5.4 In the event of loss or failure to return the suite keys, all related costs will be charged to the lead guest. The lead guest must settle the invoice within 14 days of receipt.

5.5 If keys are not returned at check-out, the lead guest must send the keys by registered mail to Isla Las Palmeras, Alora or return them in person within 2 business days.

Complaints

6.1 The guest has the right to submit complaints to the owners. The owners of Isla Las Palmeras, Alora will make every effort to address complaints adequately and promptly, as long as the complaint can be addressed reasonably and fairly.

Force Majeure

7.1 In cases of force majeure, whether permanent or temporary, Isla Las Palmeras, Alora is entitled to terminate or suspend the agreement in whole or in part without the guest claiming performance and/or compensation. Force majeure includes, but is not limited to: danger of war, war, riots, vandalism, strikes, boycotts, disruptions in energy or water supply, traffic or transport issues, government measures, raw material shortages, natural disasters, and other circumstances such as extreme weather conditions, death of an owner or close family members, where full or partial performance of the agreement cannot reasonably and fairly be required from Isla Las Palmeras, Alora.

Liability

8.1 Isla Las Palmeras, Alora cannot be held liable for any damage incurred by the guest or third parties as a result of the stay at or near the accommodation; the guest indemnifies Isla Las Palmeras, Alora against any claims in this regard. Isla Las Palmeras, Alora is not liable for disruptions to the accommodation such as power or water outages, technical malfunctions, or unannounced construction or roadworks nearby.

8.2 Isla Las Palmeras can only be held liable for damage caused by gross negligence or willful misconduct by the owners.

8.3 Notwithstanding sections 8.1 and 8.2, Isla Las Palmeras’ liability, if and to the extent that Isla Las Palmeras is legally held liable in connection with the user agreement, is limited to direct damage, and any form of consequential damage is excluded. Isla Las Palmeras’ liability is further limited to the maximum amount covered by its insurer.

8.4 Isla Las Palmeras accepts no liability for personal injury and/or damage, loss, or theft of guests’ property. Guests are expected to exercise due care in and around Isla Las Palmeras.

Final Provisions

10.1 Unless otherwise stipulated by international private law, these terms and conditions are exclusively governed by Spanish law. Non-Spanish guests are deemed to agree to the general terms and conditions written in Dutch.

10.2 Any disputes arising from the user agreement or these terms will be settled initially by the competent court in Spain, unless international private law dictates otherwise.

10.3 Neither party may transfer their rights and obligations to third parties unless otherwise specified in these terms.

10.4 If any provision of the user agreement and these terms is found to be invalid, the remaining terms will remain in effect, and the invalid provision will be deemed to be amended to align with the parties’ apparent intentions.
